PRIVACY POLICY

Sickweather Inc (“Sickweather,” “we” or “us”) has adopted this privacy policy (this “Privacy Policy” or “Policy”) to provide information about our practices with respect to the collection, use, and disclosure of information provided through our web site located at www.sickweather.com (the “Site”) and our mobile application (the “App,” together with the Site, the “Properties”).

In addition, please review our Terms of Use and Services (the “Terms”), which govern your access to and use of the Properties. By accessing, visiting and/or using any of the Properties, you agree to abide by and be subject to the Terms.

1. INFORMATION WE COLLECT.

  1. Information You Provide. When you visit or use the Properties, you may provide us with personal information (PI) (including, but not limited to, your name and email address) when you voluntarily submit this information to us, or when you connect a social media account to our Properties. You may also provide us with demographic and other information such as your gender, ethnicity, date of birth, postal code, medical preferences (e.g., western/conventional, holistic/alternative, both western and holistic), or self-reported health condition (e.g., allergies, cold, or flu). We receive this information, for example, when you (i) create a user profile; (ii) register for alerts; (iii) subscribe to receive newsletters or request other correspondence from Sickweather; (iv) provide a status update or report a health condition; or (v) otherwise provide us with information. We may associate PI and other data that you provide with other information we gather from use of the Properties or obtain from third parties.
  2. Automatically Collected Information. We may automatically collect certain information when you use our Properties. This information may include, for example, your Internet Protocol address or “IP address”; your platform advertising ID; information about your operating system, browser, and device; information about your preferences and use of the Properties; and information about the advertisements you view and whether you respond to an advertisement. We call this information Activity Information. As discussed below, we may collect this Activity Information using cookies, web beacons, tracking pixels, log files, and other technology.
    1. Browser Cookies.  We may use browser “cookies” in connection with the Properties. A cookie is a small text file that is stored on your computer’s hard drive or stored temporarily in your computer’s memory. We may use cookies to help us identify account holders and to optimize your experience using the Properties. We may also use cookies to monitor and maintain information about your use of the Properties. You may be able to refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that if you refuse our use of cookies, you may not be able to use the full functionality of our Properties.
    2. Other Technologies.  We may use other technologies such as Flash cookies and web beacons (clear GIFs) in connection with the Properties. Flash cookies help us remember user settings, preferences and usage similar to the browser cookies referenced above. Web beacons allow us to monitor and collect certain Activity Information described above. We may use web beacons to compile aggregate statistics about our Properties and our related marketing campaigns.
    3. Information Collected by Third Parties for Non-Advertising Purposes. We may work third-party services that collect information about your use of the Properties and other websites and apps over time for non-advertising purposes, such as helping us understand how visitors to our website use the website. We may use service providers, like Google Analytics, to provide these services. To learn more about how Google Analytics collects and processes data and the choices Google may offer to control these activities, you may visit www.google.com/policies/partners.     4. Log Files. We automatically recognize and log the Internet URL from which you access our Properties. We may also log your IP address, Internet service provider, and date/time stamp. We use our log files primarily for system administration and troubleshooting purposes.
  3. Location Information. We may collect geolocation data pertaining to your computer or mobile device. We may collect this information using your device’s GPS data (where available), IP address, Wi-Fi hotspot data, and cell tower locations. This data may consist of precise latitude/longitude coordinates and may be linked to a device or advertising identifier. If you do not want to provide your location to us, please use the settings available on your mobile device to limit this sharing. Please note that if you limit sharing of your geolocation data, certain features of our Properties may not work.

2. HOW WE USE YOUR INFORMATION.

We may use the information that we collect from or about the users of our Properties for our business purposes, including:

  • To operate, maintain, and improve the Properties;
  • To process and confirm transactions that you complete when using our Properties;
  • To understand our users’ behavior when they visit our Properties;
  • To perform market research and product development;
  • To communicate with our users about our products and services, including to send you alerts or other updates through our App and to confirm your registration to use the App;
  • To send marketing communications to our users on our own behalf and on behalf of third parties; and
  • To tailor our marketing and other communications to our users’ interests and to measure the effectiveness of these communications.

3. HOW WE DISCLOSE YOUR INFORMATION.

As part of the operation of our Properties, we will make certain information that you choose to provide to us publicly available. For example, when you report a health status, we will make this report publicly available on our Properties. This public report will not include PI. We may internally use your information to (i) enhance your experience of the Properties; (ii) improve the content, layout and/or design of our Properties and marketing efforts, and (iii) to determine general trends from visitors to our Properties. Additionally, when you choose to connect your social media accounts (i.e., accounts from third party social media services, such as Facebook and Twitter, “Social Media Accounts”) with the Properties, we may publish any information that we receive from your social media account, including information about your actions taken on the social media platform.

We may share Activity Information and demographic information at our discretion as well as information that has been aggregated. We may also share any PI that we collect as described below:

  • With our vendors, consultants, agents, contractors, and other service providers that we use to support our business;
  • With our affiliates, subsidiaries, or parent companies;
  • With third parties for their own marketing purposes (see below for choices regarding such sharing);
  • To provide third parties with statistics and reporting about user behavior on our Properties;
  • To respond to requests from law enforcement officials, subpoenas, court orders, or as otherwise required by law;
  • To exercise our legal rights; to defend against any claims against us; to protect the rights, property, security, and/or safety of our employees, agents, and users; to enforce our contracts, agreements, and/or terms of use; to investigate, respond to and resolve problems or inquiries; or to permit us to pursue available remedies or limit any damages we may sustain;
  • In connection with an actual or potential merger, sale, acquisition, assignment, or transfer of all or part of our assets, affiliates, lines of business, or products, including at bankruptcy; and
  • With your consent or as otherwise disclosed to you at the time of collection.

We may also share any information that we collect about your location, which may include real-time location data, with our partners for their own use, including interest-based advertising purposes. See the Digital Advertising section of this policy to learn how to control the collection and use of location information for interest-based advertising. Additionally, if you choose to click on an ad that appears on the Properties, we may share your name or other identifying characteristics with the advertiser through the referrer header (the URL transmitted by publishers when users click on ads).

Social Media. The Properties may offer you the possibility to connect your accounts from third party social media services, such as Facebook and Twitter (“Social Media Accounts”), through an application programming interface (API) or other software or functionality. By allowing the Properties to connect with your Social Media Accounts, you consent to our accessing the information in those accounts, which information may include personal information. You likewise consent to our publishing on the Properties any such information or actions you take on your Social Media Accounts. Additionally, you understand that by accessing the Properties via any of your Social Media Accounts, any activity you engage in when using the Properties may be published on the applicable third party site.

4. DIGITAL ADVERTISING

We may partner with third-party advertising companies that may use cookies, clear GIFs, web beacons, tracking pixels, or other technologies to collect information about your use of the Properties and other websites and apps over time, including information about the possible relationships among different browsers and devices, in order to provide you with more relevant advertisements both on our Properties and on other websites and apps.

This practice is called interest-based advertising. You may visit www.aboutads.info/choices to learn more about interest-based advertising and how to opt-out of this form of advertising on your web browser by companies participating in the Digital Advertising Alliance (“DAA”) self-regulatory program. Sickweather adheres to the DAA Principles.

If you wish to opt-out of the collection, use and transfer of app usage data for interest-based advertising on your mobile device by companies that participate in the DAA’s AppChoices app, you may download that app onto your device and exercise your choice. For iOS and Android users, to limit or withdraw consent for the collection and use of precise location data for use in interest-based advertising, you can turn location services off through your device settings. Please note that opting out will not stop advertising from appearing in your browser or in apps. It may make the ads you see less relevant to your interests. You may also continue to receive interest-based advertising from other companies and companies may continue to collect data for non-advertising purposes including for analytics and fraud prevention. Additionally, please note that if you use a different browser or device, erase cookies from your browser or reset your mobile device’s platform advertising ID, you may need to renew your opt-out choices.

5. DATA SECURITY

Sickweather takes commercially reasonable precautions to help protect your information from loss, misuse or alteration.

6. ACCESS TO PERSONAL INFORMATION

You may review, update, or request changes to your PI by emailing info@sickweather.com. Please include your name, street address, email address or phone number to contact you regarding the request, a clear and precise description of the data which you would like to review update, or modify and any other information that will make it easier for us to locate your personal data.

7. THIRD PARTY PROPERTIES

Our Properties may include links to third-party websites and apps. We do not control these properties or their practices with respect to your information. This Privacy Policy does not apply to any information that you provide to the operators of these linked properties. We encourage you to read the privacy policy of any third-party website or app that you visit before you provide any information to that party.

8. CHILDREN’S PRIVACY POLICY (COPPA)

Our Properties are not directed to children under the age of 13 and children under the age of 13 should not use any of our Properties. Sickweather also does not knowingly collect or maintain information collected online from children under the age of 13.

9. CHANGES TO THIS PRIVACY POLICY

We may change this Policy from time to time at our sole discretion. We will inform you of any changes to this Policy by posting a revised Privacy Policy on this website with a new effective date. We encourage you to review our Privacy Policy periodically to make sure you understand our practices with respect to your information.
